The Hon'ble Sri Justice C.V.Nagarjuna Reddy Civil Revision Petition No.990 of 2015 Dated 01.05.2015 Between:

M/s.Mathrushri Co-operative House Building Society, rep. by its President P.Nageswara Rao ... Petitioner and Smt.Ruhina Khan and 55 others

...Respondents

Counsel for the petitioner: Mr.Srinivas Karra Counsel for the respondents: Mr.P.Raghavendra Reddy The Court made the following:

Order:

This Civil Revision Petition arises out of Order, dated 25-09-2014, in IA.No.1288 of 2012 in IA.No.1011 of 2001 in OS.No.38 of 1993,

on the file of the Court of the learned I Additional District Judge, Ranga Reddy District at L.B.Nagar.

The main ground on which the petitioner- Society, which is respondent No.43 in the aforesaid IA, filed this Civil Revision Petition is that notice was sent to a wrong address and that therefore, it has not received the same.

In my opinion, the petitioner should have first moved the lower Court for recalling the order under revision, if notice was not sent to its correct address. Without filing such an application in the first instance, the petitioner cannot maintain this Civil Revision Petition. Accordingly, this Civil Revision Petition is dismissed with liberty to the petitioner to move the lower Court with appropriate application and approach this Court, if it is unsuccessful therein. As a sequel to dismissal of the Civil Revision Petition, CRPMP.No.1323 of 2015, filed by the petitioner for interim relief, is disposed of as infructuous.
