THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO.8553 OF 2014 ORDER:
Heard the learned counsel for the petitioner as well as the learned Government Pleader appearing for the respondents. The prayer sought in the Writ Petition is as under:- "...to issue a writ, order more particularly one in the nature of Writ of Mandamus declaring the action of the respondent No.4 in harassing the family members of the petitioner as being illegal, arbitrary and violative of Article 21 of the Constitution of India and consequently direct the respondent No.4 not to interfere with the life and liberty and be pleased to pass such other order or further orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."
Learned Government Pleader placed on record the written instructions dated 28.03.2014 issued by the Sub-Inspector of Police, Langer House P.S., Hyderabad.
On a perusal of the said instructions, it is revealed that the petitioner's mother, namely Fatima Banu, lodged a complaint on 21.02.2014 with the fourth respondent P.S. stating that her daughter i.e. the petitioner herein is missing since 18.02.2014. The mother of the petitioner suspected one Abdulla was responsible for her daughter's missing and requested to take necessary action. Basing on the said complaint, a case in Crime No.83 of 2014 under the head 'Woman Missing' was registered on 21.02.2014 against the said Abdulla. Instead of co-operating with the investigating agency, the petitioner filed the present Writ Petition with baseless allegations. Except registering the above
said crime, the respondent-police never harassed or interfered with the life and liberty of the petitioner at any point of time. In that view of the matter, this Court is of the opinion that there are no merits in the Writ Petition and the same is liable to be dismissed. Learned Government Pleader also brought to the notice of this Court that in view of the orders passed in W.P.No.9746 of 2014 dated 22.10.2019, no further orders are necessary in the present Writ Petition.
Thus, on both counts, the Writ Petition is dismissed. There shall be no order as to costs. Miscellaneous applications, if any, pending shall stand dismissed. ______________________ (P.KESHAVA RAO, J) 13th November 2019 RRB
