ORDER:

This Company Application is filed by the Official Liquidator under Section 454(5) and (5A) of the Companies Act, 1956 read with Rule 9 of the Companies (Court) Rules, 1959 for taking cognizance of the offence committed by the accused and for willful and deliberate non-compliance of the requirements of Section 454 (1), (2) and (3) of the Companies Act, 1956.

Today, a separate order is passed in Company Application No.1385 of 2014 and Company Petition No.6 of 2014 and this Court has recalled order, dated 22.09.2014 in Company Petition No.6 of 2014. The Official Liquidator was appointed in pursuance of the said order. With the recalling of the said order, the Official Liquidator automatically gets discharged.

Therefore, this Company Application is dismissed as infructuous.
