THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.33185 of 2011 ORDER :

The petitioner nos.1 to 3 were assigned certain lands in Pullekurru Village, Tallarevu Mandal, Sub-Registrar Kakinada, East Godavari District in the year 1996.

The petitioners contend that the said land being unfit for cultivation since 1996 they were using the land for aqua-culture, and that at that time appropriate permissions had been granted to them. They further contend that the respondents attempted to interfere with the possession of the said land by petitioners without following due process of law, and the respondents be therefore restrained from taking any action without following due process of law. 3.

Pending the Writ Petition, the 1st petitioner died, and his legal representatives have been brought on record as petitioner nos.4 to 7. 4.

The learned Government Pleader for Revenue, appearing for respondents, on instructions, states that if the respondents wish to interfere with the possession and enjoyment of petitioners' over the subject land they would follow due process of law. 5.

In view of the said submission, the Writ Petition is disposed of directing the respondents to follow due process of law if they wish to dispossess the petitioner from the subject land. No order as to costs.
