HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 33057 of 2018 ORDER:

1) Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both the parties, the writ petition is disposed of at the admission stage itself.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.4 in threatening to dispossess the petitioner from the land assigned in favour of his deceased father, vide DKT Patta No.3/4/1403, dated 29.08.1993, admeasuring Ac.1.50 cents situated in Taduku village accounts, Puttur mandal, Chittoor District, as illegal and arbitrary. 3) The grievance of the petitioner appears to be that though the assignment has been granted to the father of the petitioner and though the petitioner is in possession of the same, the Tahsildar is interfering with the same. 4) Learned Government Pleader would submit that since the petitioner has violated the conditions of assignment, the authorities have every right to cancel the assignment granted.

5) It may be true that respondent No.4 has right to cancel the patta, but the same should be done, in accordance with the provisions of law.

6) Hence, the respondents shall not interfere with the property in dispute, if the petitioner is in possession, except in accordance with law.
