ORDER:
Feeling aggrieved by the seizure of his lorry bearing registration No.AP 35 W 7195 on the ground of illegal transportation of sand, by respondent No.4, upon intimation to respondent Nos.2 and 3, the petitioner filed this writ petition. The petitioner pleaded that he has made application to respondent No.2 for release of the seized lorry and that so far no order has been passed. He has further pleaded that respondent Nos.2 and 4 are bound to release the seized lorry on payment of penalty as per G.O.Ms.No.95 dated 28.08.2014. However, the petitioner has neither given the date on which such application was filed nor he has filed a copy thereof along with the writ petition.
In the above facts of the case, respondent No.2 is directed to verify whether an application for release of the seized lorry was made as pleaded by the petitioner and if such an application is made, he shall dispose of the same in terms of G.O.Ms.No.95, dated 28.08.2014, within a period of one week from the date of
receipt of a copy of this order.
With the above directions, the Writ Petition is disposed of. As a sequel to disposal of the writ petition, W.P.M.P.No.46436 of 2015 filed by the petitioner for interim relief shall stand disposed of as infructuous. _________________________ C.V.NAGARJUNA REDDY, J 05th November, 2015 GHN
