THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.21286 of 2017 ORDER:
Heard the learned counsel for the petitioner and the learned Government Pleader for Prohibition & Excise (Telangana).
This Writ Petition is filed, under Article 226 of the Constitution of India, to direct the respondents to release the seized stocks and to follow the memo bearing No.47802/Ex.III.1/2006-13 dated 20.12.2010 issued by the first respondent.
When the matter is taken up, it is submitted by the learned Government Pleader that the petitioner herein can make an application before the Deputy Commissioner of Prohibition & Excise, Hyderabad-second respondent herein for the self-same relief and the same will be verified and considered in accordance with law.
In view of the alternative remedy available to the petitioner herein, this Court is not inclined to entertain the Writ Petition. However, it is appropriate to dispose of the present Writ Petition, keeping it open for the petitioner to make an application before the second respondent-Deputy Commissioner of Prohibition & Excise, Hyderabad for release of the seized stocks within a period
of one week from the date of receipt of a copy of this order. If any such application is made, the same may be considered and appropriate orders be passed in accordance with law within a period of two weeks thereafter.
The Writ Petition is, accordingly, disposed of. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
