HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION Nos. 11092 OF 2007 and 16803 OF 2011 ORDER :

This Writ Petition is filed seeking to declare the impugned action of the respondents, particularly the 3rd respondent, in passing arbitrary orders in OA 62/2006, dated 16.5.2007 seeking to issue certificate under Sec.133 of the Act 30/87 without even completing the enquiry and affording an opportunity to the Petitioners to present their case, without following the due process of law as illegal, arbitrary and violative of principles of natural justice etc., and consequently direct the 3rd respondent to cause proper enquiry in O.A.62/2006, by setting aside the impugned docket order dated 16.5.2007.

When the matter came up for hearing, the Counsel for the petitioners and the Government Pleader submits that the temple has been exempted under the provisions of sections 15 and 29 of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987 and has been handed over to the petitioners and the matters have become infructuous. 3.

In view of the submissions made by both the parties, no further orders are necessary in these Writ Petitions and the Writ Petitions are accordingly closed.
