HON'BLE SRI JUSTICE A. SHANKAR NARAYANA TRANSFER C.M.P. No.781 OF 2015 ORDER:

This Transfer Civil Miscellaneous Petition, under Section 24 of the Code of Civil Procedure, 1908, is preferred by the petitioner Smt. B. Jayanthi (Wife) requesting to withdraw F.C.O.P. No.50 of 2013 from the file of the Judge, Family Court at Visakhapatnam, and to transfer the same to Family Court at Vijayawada.

2. Heard Sri B. Chinnappa Reddy, learned counsel for the petitioner, and perused the material on record.

3. The reason assigned for transfer of the above F.C.O.P. is that the petitioner resides at Vijayawada, Krishna District, and she has got small children and it is difficult for her to travel all the way to the Family Court at Visakhapatnam and that M.C. No.146 of 2015 and the other criminal cases between the parties are pending in Vijayawada local Courts.

4. Keeping in view, the reasons shown, the F.C.O.P. No.50 of 2013 pending on the file of the Judge, Family Court at Visakhapatnam, is withdrawn and transferred to the file of the Judge, Family Court at Vijayawada, for trial and disposal. The Judge, Family Court, Vijayawada, is directed to issue notices to both parties and to dispose of F.C.O.P. in accordance with law.

5. Accordingly, the Transfer Civil Miscellaneous Petition is allowed. There shall be no order as to costs. As a sequel thereto, Miscellaneous Petitions, if any, pending in the present transfer petition stand closed.
