THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY Civil Revision Petition No.2320 of 2014 ORDER:

This revision petition is filed under Article 227 of the Constitution of India challenging the orders dated 11.07.2014 in I.A.No.290 of 2014 in O.S.No.1 of 2011 on the file of the Court of Senior Civil Judge, Nandigama. In spite of service of notice, none appeared on behalf of respondents 2 to 6 and 8. Heard the learned counsel for the petitioners and the learned counsel appearing for respondents 1 and 7.

Learned counsel for the petitioners and the learned counsel for the respondents 1 and 7 in one voice submitted that the impugned order may be set aside and remand the matter to the trial Court for fresh disposal in accordance with law.

In view of the submissions made by both the counsel, this Court is not inclined to go into the merits of the main case. Having regard to the facts and circumstances of the case, the orders dated 11.07.2014 in I.A.No.290 of 2014 in O.S.No.1 of 2011 is set aside and remanded the matter to the trial Court for fresh disposal in accordance with law after affording a reasonable opportunity to both parties. Accordingly, CRP is allowed. As a sequel, the miscellaneous petitions, pending if any, shall stand closed. ______________________ T.SUNIL CHOWDARY, J 20th April, 2017.
