This company petition is filed for an order for winding up the respondent for nonpayment of debt due to the petitioner. On 24.8.2015 while admitting the company petition, the petitioner was directed to carry out publication of admission in two daily newspapers and file proof of the same by today. At the hearing, there was no representation for the petitioner in the prelunch session. Therefore, the case was passed over. Even during post-lunch

session, when the case is called, there is no representation for the petitioner. Besides his non-appearance, the counsel has also failed to file proof of publication. Hence, the company petition is dismissed for non-prosecution.
