HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.1708 OF 2017 ORDER:

Sri Nimmagadda Satyanarayana, learned counsel for the petitioners, while seeking permission for withdrawal of the Criminal Petition, would make a request to dispense with the presence of petitioner Nos.1, 3 and 4 i.e., Joga Jaya Lakshmi, Joga Nagamani and Sonthi Prakasa Rao, who are arraigned as accused Nos.6, 8 and 9, respectively, before the trial Court in connection with C.C.No.856 of 2016 on the file of II Additional Judicial Magistrate of First Class, Kovvur. But, while dismissing the petition, such a request cannot be acceded to.

2. Hence, the Criminal Petition is dismissed as withdrawn leaving it open to the petitioners to avail the opportunity by invoking the appropriate provision under the Criminal Rules of Practice before the trial Court.

3. Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
