THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CONTEMPT CASE No.2238 of 2015 ORDER:

This Court, by order dated 28.05.2015, disposed of W.P.No.15083 of 2015 by giving liberty to the petitioner to file his objections to the notice dated 25.05.2015 and the fifth respondent therein was directed to consider the documentary evidence produced by the petitioner and to pass appropriate orders. Alleging violation of the said order, the present Contempt Case is filed.

In view of the allegation of occupation of land by the petitioner, this Court directed the Mandal Surveyor to measure the land and submit a report based on the sale deed submitted by the petitioner. The Mandal Surveyor accordingly submitted a report through the Tahsildar on 21.06.2016. As per the sale deed, the area from north to south is 31 feet and from east to west is 18 feet. It appears that on the ground, from north to south the land is 29 feet and from east to west it is 16 feet. The red mark portion of 13 feet was shown as the land where "racha banda" was constructed. In view of the documents possessed by the petitioner with the dimensions, the petitioner is entitled for 18 feet from east to west and it is open to the petitioner to protect that extent from encroachment.

The Contempt Case is, accordingly, closed.
