ORDER:

This writ petition is filed for a certiorari to quash Award dt.23.2.2010 in I.D. No.141 of 2009 published on 27.4.2010. I have heard this writ petition in detail on 28.7.2015. At the hearing, this Court considering the trivial nature of the charge of nonissue of one ticket after collecting fare of Rs.3.00 (Rupees three only) from a passenger felt that the punishment of removal of the petitioner from service is shockingly disproportionate to the gravity of the offence and adjourned the case to today to enable the Telangana State Road Transport Corporation (TSRTC) to reconsider the case of the petitioner.

Today, Mr. N. Praveen Reddy, learned counsel, representing Mr. N. Vasudeva Reddy, learned Standing Counsel for the TSRTC, on instructions from the Corporation has submitted that the Corporation has graciously agreed to reinstate the petitioner as a fresh Conductor without any monetary benefits for the period during which he was out of service by counting the service of the petitioner during the period when he was out of service, only for the purpose of retirement benefits. The petitioner has unequivocally agreed for this offer. For the above mentioned reasons, without dealing with the merits of the case, the writ petition is disposed of directing respondent No.2 to reinstate the petitioner as a fresh Conductor, without monetary benefits for the period during which he was out of service, by extending the benefit of counting the service only for the purpose of retirement benefits, subject to his fitness as per the Regulations of the TSRTC.

As a sequel to disposal of the writ petition, W.P.M.P. No.12600 of 2011 shall stand disposed of as infructuous.
