HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.41389 of 2015 ORDER:

This writ petition is filed praying to declare the notification issued by the 4th respondent, dated 14.12.2015 for recruitment of Anganwadi workers insofaras Dondapudi Center No.30 and Rajampalem Center No.34 as illegal, arbitrary and violative of rights guaranteed under Article 14, 16 and 21 of Constitution of India and further violative of memos dated 23.12.1998, 03.12.2010, 05.01.2012 issued by respondent Nos.1 and 2 and further to declare that the petitioners are entitled to be appointed as Anganwadi workers. 2.

When the matter is taken up for consideration, learned counsel for the petitioners as well as learned Assistant Government Pleader represents that the subject matter of the writ petition is covered by the decision of this Court in W.P.No.31374 of 2015 & batch dated 16.11.2015. On instructions, learned Assistant Government Pleader states that vacancies are available in Dondapudi Center No.30 and Rajampalem Center No.34.

Having regard to the same, the notification dated 14.12.2015 to the post of Anganwadi worker, in so far as Dondapudi Center No.30 and Rajampalem Center No.34 are concerned is set aside and the respondents are directed to consider the claims of the petitioners for appointment/promotion as Anganwadi workers in Dondapudi Center No.30 and Rajampalem Center No.34 respectively, if they are otherwise eligible and suitable.

4. Accordingly, the Writ Petition is allowed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
