This petition is filed by the petitioner-accused No.2 under Section 482 Cr.P.C. seeking to quash the order dated 22.1.2016 passed by the I Additional Chief Metropolitan Magistrate, Visakhapatnam in C.C.No.2373 of 2014.

Heard and perused the material available on record. The petitioner is alleged to have committed the offence punishable under Sections 420, 468 r/w 34 IPC and Sections 3 and 4 of the Dowry Prohibition Act. It is stated that as the petitioner did not attend before the trial Court on 22.1.2016, NBWs were issued against the petitioner.

Considering the facts and circumstances of the case, this Court is inclined to pass the following order:

"The petitioner is directed to surrender before the trial Court and move an application seeking to recall NBWs issued against him and on such application being filed, the trial Court is directed to recall NBWs issued against the petitioner and release him on his executing a personal bond for a sum of Rs.5,000/- (Rupees Five Thousand only) with one surety for the like sum to the satisfaction of the trial Court. The petitioner is directed to appear before the trial Court on all hearing dates." Accordingly, the Criminal Petition is disposed of.
