HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.1042 OF 2017 ORDER:

The present Criminal petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed requesting to quash the First Information Report in Crime No.23 of 2017 of Kurnool IV Town Police Station, Kurnool District.

The petitioners, who are arraigned as accused Nos.1 to 14, alleged to have committed the offences punishable under Sections 324, 354 and 506 read with 34 of the Indian Penal Code, 1860.

Sri V. Raghunath, learned counsel for the petitioners, would submit that just based on omnibus allegations, the petitioners have been implicated and in fact, there has been a dispute in regard to a Church and only to see that the opposite party is prevented from entering the Church, false complaint is lodged against the petitioners. The learned counsel has also drawn attention to the complaint lodged by one P. Uday Kumar, said to be an association chairman. There are certain concrete allegations levelled against the petitioners, who belong to a particular family, as to the earlier incident and the subsequent incident. Except the complaint, at this stage, no other material is forthcoming. It is too difficult, at this stage, to view that the allegations are motivated drawing inference based on the

ASNJ Crl. P No.1042 of 2017 arguments advanced by the learned counsel for the petitioners. It is a case where investigation can go on to unravel the truth. The petitioners can place their version before the investigating agency.

7. Therefore, the Criminal Petition is dismissed at the admission stage itself.

As a sequel thereto, Miscellaneous Petitions, if any, pending in the Criminal Petition stand closed.
