Akbarunnisa Begum v. Karkhana Zinda Tilismath
THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CIVIL REVISION PETITION No.6097 of 2016 ORDER:
This civil revision petition is filed under Article 227 of the Constitution of India challenging the order dated 05.12.2016 in I.A.S.R. No.15838 of 2016 in I.A.S.R.No.9595 of 2016 in I.A. No.457 of 2016 in O.S. No.846 of 2016 on the file of the Court of First Senior Civil Judge, City Civil Court, Hyderabad. 2.
Heard the learned counsel for the petitioners and the learned counsel for the first respondent. In the cause title, it is mentioned that respondent Nos.2 to 8 are not necessary parties. 3.
The petitioners are defendant Nos.5, 7, 10, 11, 13 and 14, first respondent is plaintiff and respondent Nos.2 to 8 are defendant Nos.2 to 4, 6, 8, 9 and 12.
4.
A perusal of the record reveals that in spite of direction given by the trial court, the petitioners did not choose to file the written statement. The petitioners filed the I.A.s seeking direction to the first respondent to supply copies of certain documents on the ground that they are not legible. The learned counsel for the first respondent submitted that except the petitioners, other defendants have filed written statements.
5.
Having regard to the facts and circumstances of the case, the petitioners-defendant Nos.5, 7, 10, 11, 13 and 14 are hereby permitted to file written statement before the trial court on or before 15.2.2017, failing which the trial court can proceed with the suit in accordance with law. The learned counsel for the petitioner
is informed in the open court about the last date for filing written statement.
6.
With the above direction, the civil revision petition is disposed of. Miscellaneous petitions, if any pending in this civil revision petition, shall stand closed.
