THE HON'BLE SRI JUSTICE A.VENKATESHWARA REDDY CIVIL REVISION PETITION No.3007 of 2022 ORDER:

This Civil Revision Petition is filed under Article 227 of Constitution of India assailing the impugned docket order dated 01.12.2022 in CMA No.1 of 2020 on the file of learned Principal District Judge, Siddipet.

Perused the impugned docket order dated 01.12.2022. It is extracted as under:- "DOCKET ORDER DATED : 01-12-2022 Await report and call on 14-12.2022"

The learned counsel for the revision petitioners submitted that instead of issuing fresh notice, the learned Principal District Judge was only adjourning the matter on the premise await report and infact notice of respondent Nos.1 to 3 and 5 served and notice of respondent No.4 is yet to be served. He further requested that the direction may be given to the learned Principal District Judge to expedite the disposal of the Civil Miscellaneous Appeal after effective service of notice on respondent No.4.

Therefore in the above factual matrix while recording the submissions made by the learned counsel for the

revision petitioners, this Civil Revision Petition is disposed of before admission itself with a direction to issue fresh notice for respondent No.4, if necessary by substituted service and the learned Principal District Judge, Siddipet to expedite the disposal of CMA No.1 of 2020, he shall make every endeavour to dispose of the Civil Miscellaneous Appeal within two months from the date of receipt of copy of the order. In the circumstances of the case, there shall be no order as to the costs. Miscellaneous applications, if any pending, shall stands closed.
