THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3328 of 2016 ORDER:

This Criminal Petition is filed by the petitioner-accused under Section 482 Cr.P.C., to quash the proceedings in Crime No.45 of 2016 on the file of IV Town Police Station, Visakhapatnam for the offences under Sections 417 and 420 IPC.

Heard.

On the earlier occasion, since this Court was not inclined to quash the impugned proceedings at the threshold, the learned counsel for the petitioner sought for a relief to direct the police to complete the investigation without arresting the petitioner. In view of the same, this Court directed the petitioner to file an affidavit to the effect that he would not interfere with the affairs of the de facto complainant. Now, the petitioner filed an affidavit and para 4 of the same reads thus:

"4. I submit that I deny the allegation made in the complaint. I submit that without prejudice to my rights and contentions to be raised by me and without admitting the allegations made in the complaint made by the de-facto complainant, I hereby undertake that I will not interfere with the affairs of the de-facto complainant. I respectfully submit that I have not cheated the complainant and further submit that I have not harassed the de-facto complainant in any manner and further undertake that I will not harass her in future."

In view of the above, the police concerned are directed to complete the investigation into the crime without arresting the petitioner herein and file a final report, if any, in accordance with law. The petitioner is directed to appear before the investigating agency as and when required and cooperate with the investigating agency.

Accordingly, the Criminal Petition is disposed of. Miscellaneous Petitions filed in this Criminal Petition, if any, shall

stand closed.
