THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA CRIMINAL PETITION No.718 of 2017 ORDER:

Learned Additional Public Prosecutor for the State of Telangana on behalf of respondent No.1 would represent that after completion of investigation, charge sheet was filed on 20.12.2016 and Calender Case number is yet to be assigned on the file of the Judicial Magistrate of First Class, Peddapalli.

Learned counsel for the petitioner takes note of the fact of filing the charge sheet and requests that the criminal petition may be dismissed giving liberty to the petitioner to move another petition challenging the charge sheet proceedings.

The right to file a petition under Section 482 Cr.P.C challenging the proceedings in charge sheet is not restricted. In view of the aforesaid submissions of learned Additional Public Prosecutor, the Criminal Petition is dismissed as infructuous at the stage of admission itself.

Miscellaneous applications, if any pending in the present petition, stand closed.
