THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CIVIL REVISION PETITION Nos.1272 and 1273 of 2014 COMMON ORDER:
The petitioner is a third party to O.S.No.302 of 2002, who wants to get impleaded as a third defendant in the said suit. Respondent Nos.1 to 8 herein filed O.S.No.302 of 2002 on the file of the Principal Junior Civil Judge at Medchal, Ranga Reddy District, seeking perpetual injunction against respondent Nos.9 and 10 herein. Pending disposal of the said suit, the present petitioner purchased a large extent of property where the suit schedule property is part of the same, in the year 2006. On coming to know of the same, respondent Nos.1 to 8 herein filed O.S.No.618 of 2006 seeking permanent injunction against the petitioner herein. Now, both the suits are clubbed together and it is at the stage of arguments. When the petitioner filed I.A.No.235 of 2014 and I.A.No.236 of 2014 seeking impleadment as party defendant and respondent, the applications were dismissed by a common order on 24.03.2014 on the ground that the petitioner is neither a proper party nor a necessary party to the proceedings.
Though I am in agreement with the order passed by the learned Principal Junior Civil Judge, Medchal, Ranga Reddy District, the applications filed by the petitioner also can be dismissed on another ground as the petitioner herein is a defendant in O.S.No.618 of 2006 and the said suit is also being disposed of along with the present suit i.e., O.S.No.302 of 2002, and in that view of the matter, no prejudice is caused to the case of the petitioner herein. In the circumstances, both the Civil Revision Petitions are dismissed.
At this stage, learned Counsel for the petitioner submits that the evidence in both the suits was completed and they are at the stage of arguments. Learned Counsel for the petitioner undertakes that the petitioner would cooperate with the disposal of the suit. Therefore, the learned Principal Junior Civil Judge, Medchal, Ranga Reddy District, is directed to dispose of both the suits on or before 31.03.2016. The miscellaneous petitions pending in these Civil Revision Petitions, if any, shall stand closed.
