HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.1497 OF 2017 ORDER:

The present petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'the Cr.P.C.') requesting the Court to give a direction to the learned XI-Additional Chief Metropolitan Magistrate, Secunderabad, to dispose of C.C.No.627 of 2009 within three months as it is an old case. 2.

Sri George Victor, learned counsel for the petitioner-accused No.4, would submit that accused No.1 died during pendency of the calendar case proceedings and since the concerned police have not filed the death certificate, the present case is kept pending by the learned Magistrate, and, therefore, requests to give such a direction. 3.

Heard learned Additional Public Prosecutor for the State of Telangana.

Learned Additional Public Prosecutor assures that the police concerned would file the death certificate, in case accused No.1 is no more.

Keeping in view, that the calendar case relates to 2009 and the offence alleged against the petitioner herein is punishable under Section 379 IPC, that too, in connection with pick-pocketing of a sum of Rs.16,500/-, the learned XI-Additional Chief Metropolitan Magistrate, Hyderabad, is hereby directed to dispose of C.C.No.627 of 2009 within six months from the date of receipt of the copy of the order. The petitioner herein along with other accused and the

prosecution shall cooperate in the matter so as to enable the learned Magistrate to dispose of the case within the timeline prescribed by this Court.

With the above direction, the criminal petition is disposed of at the admission stage itself.

As a sequel thereto, Miscellaneous Petitions, if any, pending in the Criminal Petition stand closed.
