THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.23597 of 2015 ORDER:
Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.
2. It is the case of the petitioner that himself, his brother and three sisters constructed 15 shops in the joint family property existing in R.S.No.913/3 of Chintalapudi Panchayat, Chintalapudi Mandal, West Godavari District. As per their internal partition/arrangement, each one of them got three shops. They constructed the shops after obtaining permission from the Gram Panchayat.
After completion of the construction, they approached respondents 3 and 4 for electricity service connection and paid necessary fee on 22.01.2015 and when they did not provide the service connection after receipt of the applications, the petitioner along with 4 others approached this Court in W.P.No.16119 of 2015. This Court, by way of an interim order dated 22.06.2015, directed the respondents therein to consider the provision of electricity service connection to the petitioners' shops within a period of 15 days from the date of receipt of a copy of that order. Pursuant to the said direction, the fifth respondent issued a letter on 14.07.2015 demanding an amount of Rs.1,91,785/- in respect of all the service connections for which applications were made by the petitioner and others. The petitioner objected to the demand of such amount on the ground that no individual charges are mentioned in the said letter, and filed the present Writ Petition.
3. When the Writ Petition came up for consideration on 29.07.2015, it was adjourned in order to enable the learned Standing Counsel to get instructions with regard to split up of the amounts. But, till today, no
instructions were received by the learned Standing Counsel and this Court is constrained to set aside the letter dated 14.07.2015 issued by the fifth respondent directing the fifth respondent to issue individual letter of charges to be paid pursuant to the applications made by the petitioner and 4 others in respect of their property existing in R.S.No.913/3 of Chintalapudi Panchayat, Chintalapudi Mandal, West Godavari District, within a period of 15 days from the date of receipt of a copy of this order.
4. With the above observation, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
