THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.10901 of 2013 ORDER:

The petitioner has twin grievances against the 4th respondent viz., initiating proceedings ROC.No.6A/ 172/ 2013 dated 15-03-2013 through Form-VIII notice as illegal and without jurisdiction and secondly not looking into the complaint against the 5th respondent namely that forged passbook is obtained by the 5th respondent and the same is not enquired into and appropriate decision taken by the 4th respondent. After perusing the material available on record and after taking note of the observation of this Court, Sri D.Jaipal Reddy requests the Court to permit the petitioner to file petition against the alleged forged documents relied upon by the 5th respondent before the 2nd respondent under Sec tion 9 of the the A.P.Rights in Land and Pattadar Pass Books Act, 1971 and the 2nd respondent may be directed to examine the same and pass orders in accordance with law.

Permission is granted.

The writ petition is disposed of by granting liberty to the petitioner to file petition before the 2nd respondent by enclosing a copy of this order. On filing such petition, the 2nd respondent is directed to hear the 5th respondent as well, peruse the record of

right and pass orders in accordance with law. No order as to costs.
