HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.32856 OF 2018 ORDER:
1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the fourth respondent in not receiving and registering the documents submitted by the petitioners, though there is no specific order prohibiting him from registering any kind of document in respect of open Plot Nos.1 to 8, 12&13, 29 to 38, 42, 48 to 54, 62 to 65, 73, 75, 80 to 82, 86, 94 to 97, 102 to 107 and 110 to 112, admeasuring 45774 sq.yards or 38273 Sq.mtrs., of My City, in Survey No. 725/ 11, situated at Shamshabad Village and Gram Panchayat, Shamshabad Mandal, Ranga Reddy district, as illegal and arbitrary.
2) The grievance of the petitioner-company is that the vendors of the petitioner-company are the absolute owners and possessors of the subject lands, having purchased the same through registered sale deeds, and also got their names mutated in the revenue records. While things stood thus, the petitioner-company presented the sale document before the second and fourth respondent for registration, who refused to receive the same. Challenging the same the present writ petition came to be filed.
with the provisions of the Indian Stamp Act and the Registration Act. If the respondents are not intending to register the documents presented by the petitioner-company, in respect of the lands referred to above, they shall return the same assigning reasons, as early as possible, preferably, within a period of four to eight weeks from the date of presentation of the document, after giving an opportunity of hearing to the petitioner and all the concerned.
4) With the above direction, the writ petition is disposed of. No order as to costs.
As a sequel to disposal of the writ petition, miscellaneous petitions, if any, pending shall stand closed.
