HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 32591 of 2018 ORDER:

1) Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both the parties, the writ petition is disposed of at the admission stage itself. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.2 in not passing orders either in stay application or in main revision petition filed by the petitioner on 28.08.2018, questioning the pattadar pass books and title deeds granted in favour of respondent No.5 by respondent No.4, in respect of petitioner's land admeasuring Acs.3.16 guntas out of Acs.8.26 guntas in Survey No.118/2 situated at Chunchupalli village and mandal, Bhadadri, Kothagudem District, as illegal and arbitrary.

3) Learned counsel for the petitioner would submit that pattadar pass books came to be issued in favour of the unofficial respondent behind his back, which fact came to him recently, leading to filing of the revision. It is his plea that though names are shown in the pahanis and adangals, but the pattadar pass books came to be issued in favour of the unofficial respondent.

4) Learned Government Pleader for Revenue would submit that the revision came to be filed in the month of August, 2018 and as such passing orders thereon may not be possible, immediately. 5) Be that as it may, having regard to the facts and circumstances of the case and taking into consideration the facts in issue, the writ petition is disposed of directing respondent No.2 to pass orders in the stay application or in the main revision itself, if possible, as early as possible, preferably within a period of two to three months from the date of receipt of a copy of the order, in accordance with law. However, Status-quo as on today to be maintained with regard to entries in the revenue records for a period of two months. 6) Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
