The grievance of the petitioner was that the Joint Collector, Khammam District, was not passing appropriate orders either on the stay petition or in the main revision filed by him against the order dated 26.04.2012 passed by the Agency Divisional Officer-cum-Revenue Divisional Officer, Kothagudem, Khammam District. By order dated 21.12.2012, this Court directed status quo obtaining as on that day in respect of the land in question and the entries in the revenue records to be maintained until further orders. The 4th respondent herein, being the respondent in the petitioner's revision, filed W.V.M.P.No.1136 of 2013 to vacate the afore-stated order.
However, the respondent authorities have not chosen to file any counter-affidavit despite passage of nearly three years since the institution of this case.
In the light of the afore-stated facts, this Court is of the opinion
that no purpose would be served in keeping this writ petition pending. The issues between the parties are to be decided by the revisionary authority on merits. No adjudication is therefore called for in this writ petition on that score. The only grievance of the petitioner was that appropriate orders were not passed by the revisionary authority at that stage. In the light of the status quo order passed by this Court, that grievance stands redressed. This Court is however informed that the revisionary authority has not disposed of the revision petition filed by the petitioner owing to the pendency of this case. The writ petition is therefore disposed of directing the 1st respondent-revisionary authority to consider the petitioner's revision filed against the order dated 26.04.
2012 passed by the Agency Divisional Officer-cum-Revenue Divisional Officer, Kothagudem, in Case No.D/200/2012 on its own merits, after giving due opportunity of hearing to the parties in accordance with law, and pass reasoned orders therein expeditiously and in any event, not later than six weeks from the date of receipt of a copy of this order. Pending the said exercise, the status quo order passed by this Court on 21.12.2012 shall remain operative.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTICE SANJAY KUMAR 1st July, 2015 IBL
