THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITON No. 36184 OF 2016 ORDER:

This writ petition is filed seeking to declare the impugned order of the second respondent bearing C.No.B1/276/2016 dated 09.09.2016 rejecting for release of seized stock.

The seizure of the Black Jaggery, Crystal Sugar Powder & Crystal Sugar Rounds, by the respondents, is challenged before this court. 3.

Inasmuch as an appeal lies against the impugned order to the Commissioner under Section 63(2) of the A.P. Excise Act, I am not inclined to entertain the writ petition. However, liberty is granted to the petitioner to approach the second respondent by invoking the provisions of Section 63(2) of the Act. If an application is made by the petitioner within ten days from today, the same shall be considered and appropriate orders be passed within two weeks thereafter in accordance with law.

The Writ Petition is accordingly disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
