HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 32629 of 2018 ORDER:

1) Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both the parties, the writ petition is disposed of at the admission stage itself.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent Nos.2 and 3 in not conducting survey and fixing the boundaries in respect of lands admeasuring Ac.0.45 cents in Survey No.96/2, situated at Nalagampalli village, Gudupalli Mandal, Chittoor District, inspite of submitting application vide No.FS011800108759 on 03.05.2018, as illegal, arbitrary.

3) Learned counsel for the petitioner would submit that though the petitioner made the application in the month of May, 2018, till date no orders are passed in the said application.

4) Learned Government Pleader for Revenue would submit that if the said application is still pending consideration, the same would be considered in accordance with law, at the earliest, if the petitioner is otherwise entitled.

5) Recording the said submission, the Writ Petition is disposed of directing the respondents to deal with the application dated 03.05.2018, seeking survey and fixing the boundaries in respect of the aforementioned land, in accordance with law, as early as possible, preferably within a period of three (03) months from the date of receipt of a copy of the order, if the petitioner is otherwise entitled. 6) Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
