HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.33743 OF 2018 ORDER:

The present writ petition came to be filed challenging the judgment dated 11.7.2018, passed by the Estate Abolition Tribunal-cumPrincipal District Judge, Krishna at Machilipatnam in T.A.S.No.1 of 2016, wherein confirmed the order dated 21.4.2016, of the Settlement Officer/Joint Collector, Machilipatnam.

A perusal of the record would show that the Estate Abolition Tribunal-cum-Principal District Judge, Krishna at Machilipatnam allowed the appeal in T.A.S.No.1 of 2016, setting aside the order of the 3rd respondent and remanded the matter back with a direction to the 3rd respondent to dispose of the same within a period of six moths from the date of receipt of copy of the said judgment. Learned Government Pleader for Revenue, would submit that the observations made in the order of the 2nd respondent, may definitely influence the 3rd respondent in deciding the proceedings in S.R.No.15(1) 1/2016, (R.Dis,) (F5) 2720/2010, dated 21.4.2016. Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 3rd respondent-Joint Collector, to dispose of the proceedings in S.R.No.15(1) 1/2016, (R.

Dis,) (F5) 2720/2010, dated 21.4.2016, uninfluenced, by the observations made by the 2nd respondent, in the judgment dated 11.7.2018 in T.A.S.No.1 of 2016, as early as possible, preferably within a period of five to six months, from the date of receipt of copy of this order. With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
