This writ petition is filed challenging the action of the second respondent in not selecting the petitioner as the lowest bidder (L1) under tender notification dated 26.05.2015 and selecting the third respondent (L4). This writ petition came up for consideration on 19.08.2015 and the petitioner was permitted to take out personal notice to the third respondent by registered post with acknowledgment due and file proof of service. The petitioner filed proof of service. Appearance was made on behalf of the third respondent. Learned counsel for the respondents 1 and 2 submitted as follows: "M/s. Srujan Services, Hyderabad has submitted its tender with the following lapses and hence its application was not considered by the committee. 1.

Certificate of Registration of the firm with the Government was not enclosed.

The firm mentioned Tanuku as Branch office in his full address at Sl.No.2 of Tender form. But on the firm letter head, no branch office (Tanuku) was indicated.

Not enclosed the Income Tax clearance certificates for the years 2012-13 and 2014-15."

In view of the same, learned counsel for the petitioner seeks liberty to pursue other remedies, which are left open to the petitioner, instead of pursuing the present writ petition.

Accordingly, this Writ Petition is closed giving liberty to the petitioner to avail other remedies, which are left open to it. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. ________________________________
