Heard Mr.T.D.Phani Kumar for petitioners and learned Government Pleader (Home) for respondents.
The petitioners pray for the following relief: "...to issue a Writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS to declare the action of the Respondents No. 4 interfering in Civil Dispute in between the Petitioner and Respondent No. 5, illegally detained the Petitioners and there by threatening the Petitioners to repay the gifted amount to the Respondent No. 5 is illegal, arbitrary and Violation of Art. 21 of Constitution of India and in violation of Provisions under Cr.P.C. and consequently direct the Respondent No. 3 & 4 not to interfere in to the Civil Disputes and not to call them to respective police Stations to settle the Civil disputes in between the Petitioner No.1 and Respondent No. 5 ..."
The writ petition, at the request of respondents, was passed over to get instructions from respondents 2 to 4. The Government Pleader basing on the written instructions received in this behalf states that as matter of fact on 12.09.2016, a complaint was made by 5th respondent against the petitioners. Officers of Task Force, it appears, on 12.09.2016 called the petitioners to attend the Station to verify the allegations made against them. After perusing the allegations made in the complaint, the Task Force Police advised the 5th respondent to file complaint before the Law and Order Police Station.
Having regard to the statement, learned Government Pleader firstly denies that petitioners are detained by respondents from morning till evening and further on account of the intimation given to the 5th respondent, the further course to call for petitioners for any purpose does not arise unless a crime is registered and presence of petitioners is required in accordance with law. The statement is placed on record and the writ petition is disposed of accordingly. No order as to costs.
