THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE SRI JUSTICE G. SHYAM PRASAD WRIT PETITION No. 37010 of 2016 ORDER: (Per VRS,J) The petitioner, who has taken a housing loan, has come up with the present writ petition, challenging a notice issued under Section 13(2) of the SARFAESI Act.

Heard Mr. B.V. Anjaneyulu, learned counsel for the petitioner. Mr. B.S. Prasad, learned standing counsel for the State Bank of India, takes notice for the respondents.

At the outset, what is challenged in the writ petition is only a notice under Section 13(2). The petitioner should file a reply raising all contentions. It is only after an order is passed under Section 13(3A) and any measure under Section 13(4) taken that the petitioner is entitled to come up before us.

Therefore, leaving it open to the petitioner to raise all objections and giving him liberty to come up as and when any adverse steps are taken, the Writ Petition is dismissed.
