THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION NO.1561 of 2016 ORDER:

Heard the learned counsel for the petitioner/A.6 and the learned Public Prosecutor.

2. The petitioner/A.6 filed the present application under Section 438 Cr.P.C seeking release on bail in the event of his arrest in connection with Crime No.01 of 2016 of Puthalaput Police Station, Chittoor District, registered for the offences punishable under Sections 447 and 379 IPC, 21 (4) MMDARA, 35 (ii) APWALTA.

3. On 04.01.2016 at 5:00 A.M., when the Sub-Inspector of Police, Puthalapattu Police Station was in the station, he received information about illegal transportation of sand.

Immediately, he secured the presence of mediators and went to the scene of occurrence. At that time, the accused persons were loading sand into the lorry. On interrogation, accused persons confessed that they committed the commission of offence.

4. Learned counsel for the petitioner submits that except confessional statement of A.1, there is no other material connecting the petitioner with the offence.

5. On the other hand, leaned Public Prosecutor submits that the material collected during course of investigation, more particularly, the confessional statement of A.1 reveal that the petitioner had committed the offence. It is said A1 to A.5 were arrested on 04.01.2016 and released on bail.

6. In view of the allegations made in the report, I am not inclined to grant anticipatory bail to the petitioner, but, however, the petitioner shall

surrender himself before concerned Court and make an application for grant of bail, after giving prior notice to learned Public Prosecutor, in which event, the same shall considered in accordance with law either on the same day or at the earliest.
