THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.43491 OF 2016 ORDER :

Apprehending that the petitioner's business is interfered with by respondents 2 and 3 at the instigation of 4th respondent, this writ petition is filed.

Heard learned counsel for the petitioner and learned Government Pleader for Industries.

No material is filed to show that the subject plot was allotted to the petitioner-industry to establish and run a small scale unit and there exists relationship between the petitioner and official respondents. It is not stated how a private person is concerned with the property belonging to the State, if what is contended by the petitioner is true that plot was allotted for establishment of industry.

Learned Government Pleader produced instructions and according to the instructions, Plot No.A-20 was allotted to M/s.Mahindra Industries by Cooperative Industrial Estate and the said M/s.Mahindra Industries gave this plot to 9 units by way of sub-lease, without approval of the respondents and action is being taken. Learned Government Pleader further submits that the entire land now vests in the Government. Thus, if the petitioner has any subsisting grievance against the 4th respondent, petitioner has to work out his remedies as available in law.

No case is made out to show that the authorities are interfering with the petitioner manufacturing activity illegally, warranting interference by this Court.

Having regard to the above, the Writ Petition is dismissed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
