THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.37664 OF 2015 ORDER:

Heard learned counsel for the petitioners and Sri B.S. Prasad, learned Standing Counsel for respondents 1 and 2. The petitioners state that the compensation amount payable to them under the Land Acquisition Act, 1894 has been credited to their savings accounts. Their grievance is that they are not permitting to withdraw the said amounts on the ground that their wives are members of the Dwakra Group and they are due certain amounts to the 2nd respondent - Bank. The petitioners have made a detailed representation on 15.10.2015 in this regard stating that they are not the sureties to the debt of their wives. Hence, this Writ Petition. Learned Standing Counsel for the respondents, on instructions, states that the 2nd respondent - Bank has already taken a decision to release the amounts to the petitioners standing in their savings accounts.

In view of the submission of the learned Standing Counsel, nothing survives in this Writ Petition, particularly when it is open for the petitioners to approach the 2nd respondent - Bank for withdrawal of the amounts from their savings accounts.

The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
