THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4933 OF 2016 ORDER:
This Criminal Petition is filed by the petitioners-A1 to A3 under Section 482 Cr.P.C., seeking to quash the proceedings against them in Crime No.409 of 2016 on the file of L.B. Nagar L & O Police Station, Cyberabad District, registered for the offence punishable under Sections 376, 420 and 406 IPC.
Heard and perused the material available on record. It is alleged that the 1st petitioner and the 2nd respondent fell in love and they used to meet frequently and the 1st petitioner had sexual intercourse with her by saying that he will marry her. Their parents performed a function of engagement and exchanged gold ornaments as formalities and fixed the date of marriage as 22.4.2016. Thereafter, the parents of the 1st petitioner viz., petitioners No.2 and 3 demanded the parents of the 2nd respondent to pay fee and other monitory aspects to the 1st petitioner, who joined in MDS in Mamatha Medical College, for which the parents of the 2nd respondent expressed their inability. On that, petitioners Nos.2 and 3 informed over phone that they are not willing to perform the marriage of the 1st petitioner with the 2nd respondent.
Considering the facts and circumstances of the case and the allegations made against the petitioners, this Court is not inclined to grant the relief sought by the petitioners. However, the 1st respondentpolice are directed to complete the investigation and file a final report, if any, in accordance with law, without arresting petitioners Nos.2 and
3. In the event of necessity, the 1st respondent-police are directed to issue notice to petitioners Nos.2 and 3 for the purpose of investigation. On issuance of such notice, petitioners Nos.2 and 3 are directed to appear before the investigating officer and give an undertaking as to
their future appearance as and when required by the investigating agency for the purpose of investigation.
