THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10107 of 2015 ORDER:

This Criminal Petition is filed by the petitioner - A1 under Section 438 of the Code of Criminal Procedure, seeking to grant bail in Crime No.112 of 2015 on the file of Atmakur Police Station, SPSR Nellore District, registered for the offences under Sections 409 and 420 read with 34 IPC.

Heard and perused the material available on record. The allegation against the petitioner is that he along with A2 hatched a plan and misappropriated the pay and allowance, leave salaries and other amounts pertaining to teaching and non-teaching staff and thereby, cheated the Government to a tune of Rs.50,93,640/-.

Learned counsel for the petitioner submitted that the petitioner is innocent of the offences alleged against him and the co-accused was already granted bail and most part of the investigation is completed and hence, he may be granted anticipatory bail.

Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner.

In the circumstances, the petitioner - A1 is directed to surrender before the Magistrate concerned on or before 21.10.2015 and on such surrender, he shall be released on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for the like sum to the satisfaction of the said Magistrate. Further, the petitioner is directed to appear before the Station House Officer concerned, daily at 10 a.m. and at 5 p.m., for a period of (10) days, from the date of receipt of a copy of this order.

Accordingly, the Criminal Petition is allowed. ______________
