There was no representation for the petitioner when this matter was taken up for hearing on 04.08.2015 and it was accordingly directed to be posted under the caption 'For dismissal' on 11.08.2015. Today, the matter appears under the said caption and when it was taken up for hearing during the pre-lunch session, learned counsel representing the learned counsel on record for the petitioner appeared and stated that the cause may not survive and that the petitioner wants to decide as to whether to withdraw the writ petition. When this Court refused to adjourn the matter on this ground, the learned counsel asked for a pass over and the matter was accordingly passed over. However, when the matter is taken up for hearing during the post-lunch session, there is no representation for the petitioner or his learned counsel. The writ petition is accordingly dismissed for non-prosecution. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
