THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13275 OF 2015 ORDER:

This Criminal Petition is filed by the complainant invoking the provision under Section 482 of Cr.P.C. challenging the order of the Additional Judicial First Class Magistrate, Nandigama dated 7.8.2015 whereby the learned Magistrate dismissed the complaint for non-appearance of the complainant-petitioner herein.

Heard the learned counsel for the petitioner. In spite of service of notice, no representation on behalf of first respondentaccused. Perused the material available on record. Considering the facts and circumstances of the case, the Criminal Petition is disposed of with the following direction: The impugned order is set aside and the Additional Judicial First Class Magistrate, Nandigama is directed to restore the complaint on its file, number the case, take the sworn statement of the complainant and dispose of the same in accordance with law.

Consequently, miscellaneous petitions, if any, pending, shall stand closed.
