HON'BLE SRI JUSTICE P. NAVEEN RAO CONTEMPT CASE NO. 1355 OF 2014 ORDER:

Petitioner management is a School. The grievance of the petitioner is that the petitioner was not granted permission to fill up the aided vacancies. The Writ Petition was disposed of by order dated 24.1.2014 directing the respondents to consider the case of the petitioner for according permission to fill up the aided vacancies, subject to fulfillment of all other conditions governing the subject, disregarding the Government Memo dated 20.10.2004. In pursuance of the said orders, the District Educational Officer, Kurnool passed orders dated 22.5.2014 for consideration of request of the petitioner and rejected the request of the petitioner.

Learned counsel for the petitioner sought to contend that the rejection ought not to have been on the basis of orders issued by the Government in G.O.Ms.No. 58 dated 13.7.2006 and therefore, the respondent has committed contempt of Court.

As seen from the order passed by this Court, the Court did not direct the respondents to consider the case of the petitioner without reference to the orders in G.O.Ms.No. 58 dated 13.7.2006. Therefore, it is not a case where the respondent violated order, much less willful and deliberate violation warranting initiation of action by this Court under the Contempt of Courts Act.

Accordingly, this Contempt Case is closed. It is needless to observe that if the petitioner is aggrieved by the said rejection orders, it is open to him to work out his remedies available under law. ______________________ P. NAVEEN RAO, J Date: 03.2.2016
