THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.12999 OF 2015 O R D E R :

This writ petition is filed for a Writ of Mandamus declaring the action of the respondent authorities in not handing over the vacant possession of Shop Nos.17 and 20 despite paying the bid amount on 27.03.2015 pursuant to the auction notification dated 18.03.2015, inspite of repeated visits followed by written representation dated 04.04.2015, as illegal and arbitrary and for a consequential direction to the respondent authorities to deliver the vacant possession of the above said shops.

The case of the petitioners is that they have emerged as successful bidders in pursuance to the auction notification dated 18.03.2015 issued by the respondents 2 and 3 with regard to leasing of the shops belonging to 3rd respondent for a period of three (03) years w.e.f. 1.04.2015 to 31.03.2018. Accordingly, the petitioners have deposited the bid amount with the respondent authorities and also complied with all formalities. Having received the bid amount, the respondent authorities are not handing over the vacant possession to the petitioners. Petitioners have also submitted representation on 04.04.2015 requesting the authorities to handover the possession. But no action has been taken so far. Aggrieved by the same, the present writ petition is filed. Heard the learned counsel for the petitioners. Sri G.

Sheshadri, learned Standing counsel for respondents 2 and 3 submits that action has been initiated against the existing lessees by issuing notices for eviction and soon after the eviction of the existing lessees, appropriate action will be taken for handing over the possession to the petitioners.

Since it is stated that representation made by the petitioners on 04.04.2015 is pending before the 3rd respondent, the 3rd respondent shall consider the same and take action in accordance with law within a period of

three (03) weeks from the date of receipt of copy of this order. With the above direction, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
