HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 33163 of 2018 ORDER:

1) The present writ petition came to be filed seeking to declare the action of the respondents No.2 to 4 in not taking action against the 5th respondent and in not conferring ownership rights on the petitioners, as illegal and arbitrary. 2) The averments in the affidavit filed in support of the petition would show that the brother of the petitioners purchased the subject land from one Maddi Bala Narasaiah, S/ o. Kistaiah from Venkata Kishan Rao, S/ o. Venkata Rama Rao Deshmukh , vide sale deed dated 08.06.1962 in Survey No.266/ 1, admeasuring Ac.2.10 gts., while the 2nd petitioner purchased agricultural land, admeasuring Ac.2.20 gts., in the same survey number from the above said person on the same date.

While matters stood thus, in the year 2000, the 5th respondent tried to forcibly enter into the petitioners' lands, against which a report was made to the Revenue Divisional Officer, for taking action against the 5th respondent. It is stated that now, again, the 5th respondent is trying to enter the petitioners' land by exerting political influence, and trying to dispossess the petitioners from the subject land.

3) As seen from the report submitted by the petitioners in the year 2000, and also the averments made in the affidavit filed in support of the petition, it is clear that the dispute is between the

petitioners and the 5th respondent, who is trying to enter into the land of the petitioners. Nowhere it is stated that any of the government officials are involved in the said act. Hence, the appropriate course for the petitioners would be to approach the civil court and avail the remedy available to them under law. 4) Having regard to the above, the writ petition is dismissed at the admission stage. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
