THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9768 OF 2016 ORDER:

This petition is filed by the petitioner-accused under Sections 437 and 439 Cr.P.C. seeking to grant bail to him in Crime No.79 of 2016 on the file of Geesugonda Police Station, Warangal District, registered for the offence punishable under Sections 376(2)(I) and 420 IPC.

Heard and perused the material available on record. It is alleged that the petitioner cheated the victim, who is a mentally challenged girl, and made her pregnant. Learned Counsel for the petitioner submitted that the victim was a married woman and she led marital life with her husband and took divorce from her husband and that the victim is not an innocent woman and the petitioner is not responsible for the pregnancy of the victim and that the petitioner was arrested on 18.4.2016 and since then, he has been in prison.

Learned Additional Public Prosecutor opposed this petition. Considering the facts and circumstances of the case and the gravity of the offence, this Court is not inclined to grant bail to the petitioner.
