HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.32698 of 2018 ORDER:

The grievance of the petitioner in the writ petition is that his son by name PM Chakrapani died on 05-07-2017 and a case in Cr.No.117 of 2017, dated 07-07-2017 was registered on the file of Kuderu Police Station, Kuderu, Ananthapuram District under Section 174 Cr.P.C. In respect of death of his son, the petitioner has suspicion and made representations on 15-10-2017 and 18-10-2017 to the 3rd respondent for expeditious investigation of the matter and also to enquire into the cause of death of his son. But as on today, no report is filed. Aggrieved by the same, the present writ petition is filed.

Learned counsel for the petitioner submits that the petitioner has approached the higher authorities to take action on his representations, as he is suspecting death of his son.

Learned Assistant Government Pleader for Home basing on written instructions submits that two months time is required for filing appropriate report in the concerned Court. In view of the same, this writ petition is disposed of directing the 5th respondent to investigate the case and file appropriate report as expeditiously as possible, keeping in view the representations dated 15-10-2017 and 18-10-2017 filed by the petitioner, preferably within a period

of two months from the date of receipt of a copy of this order, keeping in view of spirit under Section 173(1) Cr.P.C. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
