This transfer petition is filed by the petitioners to transfer FCOP No.533 of 2015 on the file of Additional Family Court Judge, Visakhapatnam, to the Court of Family Judge, Vijayawada at Krishna District.

It is the case of the petitioners that the respondent filed I.A.No.502 of 2015 in O.P.No.357 of 2015 on the file of the Family Court Judge at Vijayawada for custody of minor children. The petitioner got shifted to Vijayawada due to admission of her children in St.John English Medium High School, Vijayawada and she is also doing job in Vijayawada. It is also stated that the respondent got filed OP No.357 of 2015, which is pending at Family Court Judge at Vijayawada, which is also convenient for the respondent. That she is unable to travel to Visakhapatnam for prosecuting FCOP No.533 of 2015 at Additional Family Court, Visakhapatnam. As such, she sought to transfer FCOP No. 533 of 2015 on the file of Additional Family Court Judge, Visakhapatnam, to the Court of Family Judge, Vijayawada at Krishna District.

Though notice is served on the respondent, no counter is filed opposing the same.

Since OP No.357 of 2015 is pending on the file of the Court of the Judge, Family Court, Vijayawada and petitioner is also residing along with her parents at Vijayawada and doing job, it is convenient for both the petitioner as well as respondents, if the FCOP No. 533 of 2015 on the file of Additional Family Court Judge, Visakhapatnam, is transferred to the Court of Family Judge, Vijayawada at Krishna District. In view of facts and circumstances, FCOP No.533 of 2015 on the file of Additional Family Court Judge, Visakhapatnam is transferred to

the Court of Judge, Family Court, Vijayawada at Krishna District. Accordingly, the Tr.CMP is allowed. No costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 05.02.2016 Note: issue CC by tomorrow.
