HONOURABLE SRI JUSTICE GUDISEVA SHYAM PRASAD CRIMINAL PETITION No. 8661 OF 2011 O R D E R :

This Criminal Petition is filed under section 482 of Cr.P.C., seeking to quash the proceedings in Crime No. 145 of 2011 of Dharmapuri Police Station, Karimnagar district.

2. Heard the learned counsel for the petitioners and the learned counsel for the second respondent.

3. The learned counsel for the petitioners submitted that without going into the merits of the case, since this petition is filed in the year 2011, sought for a direction to the Police with the investigation by following the procedure under section 41-A Cr.P.C., following the directions in the case of ARNESH KUMAR V/s. STATE OF BIHAR.

4. Considering the request of the learned counsel for the petitioners, since this case is of the year 2011 and the interim stay is granted and no further proceedings have taken place so far, as it is not disputed by the counsel for the second respondent. It would be appropriate for a direction is given to the police for further investigation by following the procedure under section 41-A of Cr.P.C. and

the directions rendered in that regard in the case of ARNESH KUMAR V/s. STATE OF BIHAR.

5. Accordingly, this Criminal Petition is disposed of.

6. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition stands vacated.
