THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.2603 of 2016 ORDER:
This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioner/A-2 in C.C.No.1326 of 2015 pending on the file of II Additional Judicial Magistrate of First Class (Designated Court for CID cases) at Eluru, arising out of Crime No.107 of 2012 of Tadepalligudem Police Station registered for the offences punishable under Sections 419, 468, 471, 120-B and 420 read with Section 34 IPC. Heard and perused the material available on record. Learned counsel for the petitioner/A-2, while not pressing the main relief as sought for, confined his arguments only to the extent of recalling of warrant pending against him in the above case.
Considering the facts and circumstances of the case, since it is stated that the petitioner/A-2 intends to appear before the Court for facing the trial, the petitioner is directed to surrender before II Additional Judicial First Class Magistrate (Designated Court for CID Cases) at Eluru and file a petition for recalling of warrant issued against him and on filing of such petition, the learned Magistrate shall consider the same and recall the warrant on the same day on execution of a personal bond for Rs.5,000/- (Rupees five thousand only) with one surety to the satisfaction of the learned Magistrate and also on giving an undertaking to appear before the Court regularly on all hearing dates. With the above direction, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending, shall
stand closed.
