THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.17128 of 2015 ORDER:
The grievance of the petitioner is with regard to the action of the respondent - Bank in seizing his Tractor and Trailer on the ground of alleged default in repayment
of the vehicle loan availed by him.
This Court is of the opinion that this writ petition does not involve a public law element and raises a purely private contractual dispute between the parties. Merely because the respondent - Bank is a scheduled bank, it would not entitle the petitioner to invoke the extraordinary jurisdiction of this Court under Article 226 of the Constitution of India.
The writ petition is therefore dismissed leaving it open to the petitioner to avail appropriate remedies before the competent forum in accordance with law. Pending Miscellaneous Petitions shall also stand dismissed. No order as to costs.
